To authorize and regulate the use of the oleoresin capsicum (OC) aerosol dispenser (pepper spray) by trained institution staff. Consistent with the Program Statement Use of Force and Application of Restraints, OC aerosol spray may be used to incapacitate or disable disruptive, assaultive, or armed inmates or others posing a threat to the safety of others, or to institution security and good order. If the OC aerosol spray is not effective, other alternative munitions should be considered

This Program Statement provides policy and procedure regarding the Bureau of Prisons inmate classification system. The classification of inmates is necessary to place each inmate in the most appropriate security level institution that is the same meets their program needs and is consistent with the Bureau’s mission to protect society. The Bureau’s classification, designation and redesignation procedures are consistent with the statutory authority contained in 18 U.S.C. § 3621(b). End of

The Release Preparation Program’s (RPP) purpose is to prepare each inmate to re-enter the community successfully and particularly, the work force. Implementing this Program Statement will ensure that the purpose and scope of all institution/unit release preparation programs are consistent throughout the Bureau.

To establish procedures required for juveniles under the age of 18 and those sentenced under the Federal Juvenile Justice and Delinquency Prevention Act (JJDPA). The JJDPA (18 U.S.C. §§ 5031 through 5042) specifies the requirements for a juvenile who has not attained his or her 18th birthday and any juvenile sentenced under the JJDPA as a juvenile delinquent.

Expected results of this program are: Inmates will be notified of the “Treaty Transfer Program” during the Admission and Orientation Program (A&O). Inmate transfers will be voluntary; the inmate must consent to the transfer; and both countries must approve transfer. Eligible inmates approved for transfer will be transferred to or from foreign countries under the treaty and the receiving country will be responsible for administering the transferred sentence in accordance with their laws.

The expected results of this program are: A motion for a modification of a sentence will be made to the sentencing court only in particularly extraordinary or compelling circumstances that could not reasonably have been foreseen by the court at the time of sentencing. The public will be protected from undue risk by careful review of each compassionate release request. Compassionate release motions will be filed with the sentencing judge in accordance with the statutory requirements of 18 U.S.C. 3582 or 4205(g).

To ensure the Bureau of Prisons (Bureau) properly identifies, tracks, and provides services to the transgender population, consistent with maintaining security and good order in Federal prisons.

All claims for damage to, or loss of, an inmate’s privately owned property detained by staff should be processed under the Small Claims Act, 31 U.S.C. § 3723. This Program Statement instructs staff on the system for filing, investigation, and payment of these inmate property claims. The expected results of this program are: Inmate property claims will be acknowledged, investigated, and approved or denied within the time frames and according to the procedures in this Program Statement.

To provide inmates an opportunity to purchase articles or services not issued or delivered as basic care by the institution or of a different quality. Expected results of this program are: ?Efficient and reliable commissary, telephone, and laundry services will be made available to inmates. ?The Trust Fund operation will be managed to ensure an efficient, cost-effective, self-supporting program. ?Merchandise, supplies, foods, and equipment will be received, securely stored, and effectively distributed. ?Inmates’ funds (Deposit Fund) will be accurately and efficiently maintained.

To ensure the Bureau provides programs, services, and policies that are gender-responsive, trauma-informed, culturally sensitive, and address the unique needs of incarcerated females at facilities that house female offenders. This policy addresses specific needs of female offenders within the Bureau of Prisons; this policy is not intended to provide preferential treatment based solely on gender.
