To authorize and regulate the use of the oleoresin capsicum (OC) aerosol dispenser (pepper spray) by trained institution staff. 5140.42 Transfer of Offenders To or From Foreign Countries

Expected results of this program are: Inmates will be notified of the “Treaty Transfer Program” during the Admission and Orientation Program (A&O). Inmate transfers will be voluntary; the inmate must consent to the transfer; and both countries must approve transfer. Eligible inmates approved for transfer will be transferred to or from foreign countries under the treaty and the receiving country will be responsible for administering the transferred sentence in accordance with their laws.

5050.50 Compassionate Release/Reduction in Sentence

The expected results of this program are: A motion for a modification of a sentence will be made to the sentencing court only in particularly extraordinary or compelling circumstances that could not reasonably have been foreseen by the court at the time of sentencing. The public will be protected from undue risk by careful review of each compassionate release request. Compassionate release motions will be filed with the sentencing judge in accordance with the statutory requirements of 18 U.S.C. 3582 or 4205(g).
