Reason for the change in law

In 2010 and 2011, the Belgian Gambling Act was fundamentally revised and expanded. This was the first time that online gambling was included in this law. Since the introduction of these new regulations, the Gaming Commission (GC) has been monitoring real and online casinos more closely.

Only in 2017 did the Brussels Court of Appeal officially decide that operators would be allowed to offer various forms of online entertainment in the future. Now this decision has been withdrawn.

The law from 1999 was already comprehensively replaced by new regulations in 2019. One of these rules addresses the separation of online gambling and online betting.

Contrary

The Constitutional Court’s decision to have the law processed is challenged by the Council of Ministers in 2018. The claim itself supported the European Gaming and Betting Association (EGBA).

Both argued that real casino operators could offer different types of gambling in one place. If online casinos were limited to one offer, they would be at a disadvantage.

The Council of Ministers of the Belgian government criticized the decision at the time. In his opinion, internet platforms are not the right place to gather gambling and online betting. These arguments were long rejected by the competent court.

Was ändert sich für Betreiber?

Auf viele Betreiber von Online-Casinos kommt mit der Realisierung dieses Gesetzes eine große Umstellung zu.

Glücksspiele und Sportwetten müssen zukünftig über getrennte Domains angeboten werden. Eine Verlinkung mit und Werbung für die so entstehenden Partnerwebsites ist nicht erlaubt. Beliebte Tischspiele wie Blackjack und Roulette werden zukünftig nur noch von realen Casinos angeboten. Sie sind aber auch auf den Websites dieser lizenzierten Anbieter verfügbar. Poker hingegen darf weiterhin online angeboten werden.

Das neue Urteil verpflichtet Betreiber, ihr Online-Casino und ihre Wettdienste aufzuteilen. Bei Zuwiderhandlung droht der Entzug der Glücksspiellizenz.

Ein Beispiel dafür ist die Website betway.be vom Konzern Casinos Austria International (CAI). Diese bot Online-Wetten und -Glücksspiele trotz der Gesetzesänderung weiterhin zusammen an. Daraufhin wurde ihr die Glücksspiellizenz entzogen. Als weitere Konsequenz musste betway.be seine Website vollständig schließen.

Was ändert sich für Benutzer?

Die Kombination von Sportwetten und Online-Casinos hat es Spielern bisher einfach gemacht. Jeder konnte beide Spielarten nach Herzenslust auf einer Seite spielen. Man hatte bequem und schnell Zugriff auf beliebig viele Online-Casinos. Alle Spiele und Wetten waren auf einer Domain verfügbar. Die Spieler brauchten bloß eine ID und ein Passwort.

Das wird sich jetzt in Belgien grundlegend ändern. Sie müssen verschiedene Konten eröffnen und separate Einzahlungen tätigen. Bei jedem neuen Anbieter muss man sich neu ausweisen.

Das bedeutet einen erheblichen Mehraufwand für Benutzer. Es ist fraglich, ob dies auf Zustimmung trifft. Die Regierung hofft, Online-Glücksspiel damit unattraktiver für die Spieler zu machen. Ob dies gelingt, bleibt abzuwarten.
